Sondar Technologies Pty Ltd, ABN 19 656 306 428 ("we", "us", "our") provides an AI-powered Customer Intelligence platform. We respect the privacy of our commercial clients ("Customers") and the individuals whose data is processed by our system ("End Users").

This Privacy Policy outlines how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Our Role: Processor vs. Controller

It is important to understand our role in handling data:

  • For Client Data (B2B): When we collect data about our direct B2B clients (e.g., your login details, billing info), we act as a Data Controller.
  • For Customer Intelligence Data (End User Data): When you upload sales calls, user interviews, or CRM records to our platform for analysis, we act strictly as a Data Processor. We process this data solely on your instructions and do not own it.

3. Information We Collect

3.1 Information You Provide to Us

  • B2B Account Data: Business contact information, login credentials, and billing details.
  • Intelligence Data: Data you upload for analysis, which may include:
    • Audio recordings of sales/support calls.
    • CRM records and metadata.

3.2 A Note on Voice Recordings (Surveillance Devices)

Our platform analyzes voice data provided by you. By uploading recorded calls, you warrant that you have obtained all necessary consents required by law (including the Surveillance Devices Act 1999 (Vic) and the Telecommunications (Interception and Access) Act 1979) to record and share these conversations.

4. How We Use Artificial Intelligence (AI)

4.1 The "No Training" Guarantee

We use AI to provide insights for your specific business only.

  • We DO NOT use your Customer Intelligence Data (e.g., your sales calls) to train, fine-tune, or improve our artificial intelligence models for the general public or for other customers.
  • Your data remains isolated and is used solely to generate outputs (e.g., transcripts, sentiment analysis) for you.

4.2 Automated Insights (Not Decisions)

Our AI provides recommendations and intelligence (e.g., "High Churn Risk"). It does not make automated legal or significantly affecting decisions. You agree that all final business decisions are made by human operators.

5. Data Retention and Deletion

5.1 Retention During Subscription

We retain your Customer Intelligence Data (including recordings and CRM records) for as long as your account remains active. This allows you to access historical insights, track trends over time, and maintain a complete record of your intelligence activities within our platform.

5.2 Customer Control

You maintain full control over your data. You may manually delete specific records (e.g., specific call recordings or contacts) at any time through the platform interface. Once deleted by you, this data is removed from our active production servers immediately.

5.3 Deletion Upon Termination

If you cancel your subscription or cease to be a customer:

  • Grace Period: We may retain your data for a short grace period to allow for account reactivation or data export.
  • Final Deletion: All Customer Intelligence Data will be permanently deleted from our systems within 30 days of contract termination.

6.1 International Transfers (APP 8)

While our primary storage is in Australia, our AI partner (OpenAI) may process data in the United States. We ensure reasonable steps are taken to protect your data, including the use of Enterprise agreements that prevent OpenAI from training their models on your data.

7. Security (APP 11)

We utilize enterprise-grade security measures, including:

  • Encryption: Data is encrypted in transit (TLS 1.2+) and at rest (AES-256).
  • Access Control: Strict role-based access for our internal staff; we do not access your raw sales calls unless required for technical support and explicitly authorized by you.
